Terms of Service#

These Terms of Service ("Terms") govern your use of domani.sh ("we", "us", "our", "the Service"), including our website, API, CLI tool, and all related services. By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Overview#

domani.sh is a domain name registration service that provides an API, CLI tool, and web dashboard for searching, purchasing, and managing domain names. The Service is designed for developers, businesses, and automated agents.

2. Eligibility#

To use the Service, you must:

Be at least 18 years of age, or the age of majority in your jurisdiction
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the Service under applicable law
Provide accurate and complete registration information

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Account Registration#

3.1 Account Creation#

To use the Service, you must create an account by providing a valid email address. Upon registration, you will receive an API key that grants access to the Service.

3.2 Account Security#

You are responsible for:

Safeguarding your API keys and authentication credentials
All activity that occurs under your account, whether or not you authorized it
Immediately notifying us if you suspect unauthorized access to your account

We recommend using separate API tokens for different applications and revoking tokens that are no longer needed.

3.3 Account Termination#

You may delete your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the Service.

Upon termination:

Your API keys will be immediately revoked
Active domain registrations remain yours and can be transferred to another registrar
We will retain transaction records as required by law (see our Privacy Policy)

4. Domain Registration#

4.1 Registration Process#

When you purchase a domain through the Service:

We register the domain on your behalf through our registrar partner
You become the registrant of record, subject to the policies of the relevant domain registry
Registration is for a period of one (1) year, renewable annually
Domain registration is subject to availability at the time of purchase

4.2 ICANN Compliance#

Domain registrations are subject to ICANN (Internet Corporation for Assigned Names and Numbers) policies, including but not limited to:

The Registrant Rights and Responsibilities
The Uniform Domain-Name Dispute Resolution Policy (UDRP)
Registrant data accuracy requirements
Transfer policies

You agree to comply with all applicable ICANN policies.

4.3 Domain Disputes#

We are not responsible for resolving disputes between domain registrants and third parties. Domain name disputes are subject to the UDRP and applicable law. We will comply with decisions of ICANN-approved dispute resolution providers and court orders.

4.4 Prohibited Registrations#

You may not use the Service to register domains for:

Phishing, malware distribution, or other malicious purposes
Trademark infringement or cybersquatting
Spamming or unsolicited bulk communications
Any activity that violates applicable law

We reserve the right to suspend or cancel domain registrations that violate these Terms, with or without notice.

4.5 Domain Renewal and Expiration#

You are solely responsible for renewing your domains before they expire
We may send expiration reminder emails, but the absence of such reminders does not affect your responsibility
Expired domains may enter a redemption period, after which they become available for registration by others
We do not guarantee the ability to recover expired domains

5. Pricing and Payments#

5.1 Pricing#

Domain prices vary by TLD (top-level domain) and are displayed at the time of search
Prices are listed in US Dollars (USD)
Prices may change at any time; however, the price displayed at the time of purchase will be honored for that transaction
Current pricing is always available via GET /api/tlds

5.2 Payment Method#

A valid payment method must be on file before purchasing domains
Payment is processed through Stripe, Inc. and is subject to Stripe's terms of service
Your card is charged immediately upon purchase

5.3 Refunds#

Domain registrations are non-refundable once completed, as we cannot reverse a registration with the domain registry
If a registration fails for technical reasons, you will not be charged
Billing disputes should be directed to support@domani.sh within 30 days of the charge

5.4 Taxes#

Prices do not include taxes unless explicitly stated
You are responsible for any applicable taxes, duties, or government levies arising from your use of the Service

6. API and CLI Usage#

6.1 Acceptable Use#

You may use the API and CLI for any lawful purpose, including:

Searching for and purchasing domain names
Managing DNS records for domains you own
Building applications and integrations that consume the API
Automated domain management by AI agents and bots

6.2 Rate Limits#

The API enforces per-endpoint rate limits to ensure fair usage and service stability. Current limits are documented in our API reference. Exceeding rate limits will result in HTTP 429 responses with Retry-After headers.

You must not:

Circumvent or attempt to bypass rate limits
Use multiple accounts to increase rate limits
Perform automated scanning or enumeration of domain availability at scale beyond the provided rate limits

6.3 API Availability#

We aim to provide high availability but do not guarantee uninterrupted service
We may perform maintenance that temporarily affects availability, with reasonable advance notice when possible
API responses are not guaranteed to be real-time; cached data is clearly indicated

6.4 API Changes#

We may update, modify, or deprecate API endpoints
Breaking changes will be communicated in advance when feasible
We recommend subscribing to API status updates

7. Referral Program#

7.1 How It Works#

Each user receives a unique referral code. When a new user registers using your referral code and purchases domains, you earn a commission on each purchase.

7.2 Commission Terms#

Commission rates are set by us and may change at our discretion
Commissions are calculated per domain purchase made by referred users
Commissions are tracked in your account and paid out according to our payout schedule
We reserve the right to withhold or reverse commissions earned through fraudulent referrals, self-referrals, or violations of these Terms

7.3 Prohibited Referral Practices#

You may not:

Create fake accounts to generate referral commissions
Use misleading or deceptive advertising to promote your referral code
Spam or send unsolicited messages to promote your referral code
Offer financial incentives to users for using your referral code (e.g., cashback, rebates)

Violation of these rules may result in forfeiture of all commissions and account termination.

8. DNS Management#

8.1 DNS Records#

You may configure DNS records for domains you own through the Service. You are solely responsible for the correctness and consequences of your DNS configurations.

8.2 DNS Propagation#

DNS changes may take up to 48 hours to propagate globally. We are not responsible for delays in DNS propagation or issues caused by incorrect DNS configurations.

9. Intellectual Property#

9.1 Our Property#

The domani.sh name, logo, website design, API design, documentation, and all related intellectual property are owned by us. You may not copy, modify, or redistribute any part of the Service without our written consent.

9.2 Your Content#

You retain ownership of your domains, DNS configurations, and any content you host on domains registered through the Service. We do not claim any rights to your content.

9.3 Feedback#

If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, perpetual license to use that feedback to improve the Service.

10. Disclaimer of Warranties#

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR RELIABILITY OF RESULTS
UNINTERRUPTED OR ERROR-FREE OPERATION

WE DO NOT WARRANT THAT:

THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS
DOMAIN REGISTRATION WILL ALWAYS BE SUCCESSFUL
DNS CHANGES WILL PROPAGATE WITHIN ANY SPECIFIC TIMEFRAME
THE SERVICE WILL BE AVAILABLE AT ALL TIMES

11. Limitation of Liability#

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or business
- Loss of data or domain names
- Cost of procurement of substitute services
- Service interruptions or downtime
- Unauthorized access to your account
- DNS misconfigurations or propagation delays

THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

12. Indemnification#

You agree to indemnify, defend, and hold harmless domani.sh and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights, including intellectual property rights
Domains you register and their use
DNS configurations you create
Content you host on domains registered through the Service

13. Governing Law and Disputes#

13.1 Governing Law#

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

13.2 Dispute Resolution#

Any dispute arising from these Terms or the Service shall be resolved as follows:

Informal resolution - Contact us at support@domani.sh. We will attempt to resolve the dispute within 30 days.
Binding arbitration - If informal resolution fails, the dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
Small claims - Either party may bring claims in small claims court if the claim qualifies.

13.3 Class Action Waiver#

You agree to resolve disputes with us on an individual basis. You waive any right to participate in a class action, class arbitration, or representative proceeding.

14. Modifications to Terms#

We may modify these Terms at any time. When we make material changes:

We will update the "Last updated" date at the top of this page
We will notify registered users via email
Continued use of the Service after notification constitutes acceptance

If you disagree with modified Terms, you must stop using the Service and may request account deletion.
